ON DEMAND: CIG Act processes: Part 26A Restructuring Plans

We will provide an introduction to a Part26A Restructuring Plan (“RPs”) and take a look at practical examples of RPs launched to date.

Overview:

Arguably the most significant change to the UK insolvency and restructuring market since the Enterprise Act 2002, the restructuring plan (RP) introduced by the Corporate Insolvency and Governance Act 2020 (CIGA) as a new Part 26A to the Companies Act 2006, is a procedure which is intended to enhance the UK’s rescue and restructuring culture, and is a mechanism to allow companies to reach a statutory compromise with creditors and thus avoid insolvency. 

This course, which is perfect for all levels of professionals as an introduction to Part 26A Restructuring Plans comprises 2 parts – Part 1 covers how these plans work, when to use, the procedure and impact on stakeholders, including the new cross-class cram down provision. Part 2 of the course comprises practical examples in respect of two large enterprises who have used RPs – one plan that was court sanctioned and one that didn’t receive court sanction - and includes some key takeaways.
